The mycar Chargers

Terms and Conditions

IMPORTANT – THE TERMS AND CONDITIONS (“TERMS”) APPLY TO ALL PARTICIPANTS IN THE “MYCAR CHARGERS” PROGRAM. BY TICKING THIS BOX, YOU AGREE TO BE BOUND TO THE TERMS SO PLEASE ENSURE THAT YOU READ THEM CAREFULLY.

Background:

We are Tyre and Auto Pty Ltd (ABN 57 164 707 484) trading as mycar Tyre & Auto (“mycar”, “we” or “our”). A Participant is an individual who owns an eligible Electric Vehicle and agrees to these Terms (“Participant”, or “You”).

After natural disaster events, the “mycar Chargers” program will deploy a team of Participants in their Electric Vehicles (“EV’s”) to provide battery power to members of impacted communities. Members of these communities can use battery power from the Participant’s EVs to charge household items (“Program”). The Program will be based at local disaster recovery hubs (for example schools or community centres). No formal training is required for Participants to participate in the Program.

At each site, there will be a Lead Charger who will act as a liaison between the disaster-impacted community and the Participants. Participants will only be invited to participate in the Program once the area is deemed safe for their participation by relevant emergency services and government authorities and the post-disaster response has commenced. Participants will be guided by the Lead Charger with instructions regarding how to assist community members to charge their items safely. If there is a disaster within a 250-kilometre radius of the address provided by the Participant, the Participant will be sent a SMS to alert them and put them on standby that their participation may be needed. The SMS will be followed by an email with more information and the Participant will have the chance to confirm their availability. Participants may choose to assist at multiple locations in a single day provided they have adequate power to travel to an additional site and back home and they have the availability to assist.

The Program involves driving to natural disaster impacted areas and using your EV to assist community members to charge their household items. There are inherent risks of damage both to you and your property (including your EV) by participating in the Program. This document contains pre-conditions with which you must confirm you comply and general terms to which you must agree in order to participate in the Program.

  3. We may film or record your participation in the Program at any time.

11. Liability

  1. Your safety is our highest priority, but you acknowledge that the Program involves driving (sometimes long distances) to disaster impacted areas which may be unsafe where there are inherent risks of death, injury or damage to both you and your property. To the maximum extent permitted by law, by participating in the Program, you accept these risks and waive our liability.
  2. You agree that you accept that you share in the responsibility to maintain your own safety and that of others and of property by your own actions or conduct throughout the Program.
  3. We are in no circumstances liable to you to the extent any liability arises due to your non-compliance with these Terms or your failure to comply with reasonable instructions from the Lead Charger(s) or emergency services personnel.
  4. To the extent permitted by law, you shall hold harmless and release us and our related bodies corporate from any responsibilities and liability for any costs, losses or damage arising from any act or omission whatsoever (whether inside or outside our control or by negligence, neglect or otherwise) of you, us, or our personnel, on or relating to the Program. This limitation of liability extends to any loss or damage arising from any accident, detention, diversion or theft in regard to personal belongings, or in respect of direct or indirect or consequential loss or damage, death, injury, medical expenses, sickness, irregularity, delay liability and additional expenses, inconvenience or any event beyond our control including accident or failure to machinery or equipment, or other services, or any acts of God, dangers, fire, acts of government or other authorities, delays, strikes or cancellations whatsoever, howsoever by whosoever caused.
  5. Notwithstanding any other provision in these Terms to the contrary, to the extent permitted by law, in no event shall we, our officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our websites, products or services generally (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from our websites, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via our websites, whether based on warranty, contract, tort, or any other legal theory, and whether or not we are advised of the possibility of such damages.
  6. While the foregoing limitations of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction, where conditions, warranties or other rights are implied in these Terms or otherwise conferred by law, and it is not lawful or possible to exclude them, then those conditions, warranties or other rights will (but only to the extent required by law) apply to these Terms. For clarity, nothing in these Terms purports to or does limit the application of any statutory consumer warranties or rights you may have.
  7. To the extent permitted by law, you agree to defend, indemnify and hold harmless us, our officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your participation in the Program; (ii) your use of and access to our websites; (iii) your violation of any term of these Terms; (iv) your violation of any third party right, including without limitation any copyright, intellectual property, or privacy right; or (v) any damage or injury you may cause to a third party or any property. This defence and indemnification obligation will survive these Terms. Your obligation to indemnify under this clause shall be reduced proportionately to the extent that the negligent act or omission of those indemnified caused or contributed to the relevant loss.
  8. Nothing in these Terms shall exclude any liability that cannot be excluded by law.

12. Severability
Any term of this agreement which is fully or partly void or unenforceable is severed to the extent that it is void or unenforceable, and the remainder of this agreement continues in force.
