Terms and Conditions of Vehicle Inspection Report

1. General

These terms and conditions form part of the contract (agreement) between Tyre and Auto Pty Ltd ABN 57 164 707 484 trading as mycar Tyre & Auto (we, us, or mycar) and the customer (you) that is formed when:

  • You sign a form issued by us that describes services that we will perform (Service Authorisation); or
  • When you provide us with the vehicle key and by doing so you authorise us to perform the agreed services (or amended services as a result of updated instructions from you) on the vehicle; or
  • When we agree to sell products to you or when you book and/or pay for our products or services via our website www.mycar.com.au.

In addition, our Terms and Conditions of Sale and Provision of Service (Service Terms) are available on our website and apply where applicable. Please see our Service Terms to find out more about things like our payment terms, your consumer entitlements, our approach to privacy, and what to do if you have concerns. Together these terms embody the whole agreement between you and us.

We will not undertake a road test on any vehicle which appears, as determined by our team member, not to be in a roadworthy condition or if the vehicle is not registered in the relevant state.



2. We are independent

This is an independent vehicle inspection for the purpose of transfer of ownership. mycar provides Vehicle Inspection Reports (Reports) as a third-party inspector. We have no affiliation to the person who has paid for the report (you or Customer) whether buyer or seller. We will not complete inspections for family, friends or anyone related to the inspector.

The report will be sent directly to the Customer. It is up to the Customer to decide whether or not the contents of the report with be shared as part of the sale negotiations and mycar will not be involved in negotiation or disputes regarding the findings of the inspection of the vehicle.



3. What the inspection includes

The Report is based on an inspection that is visual and non-mechanical only and includes a limited road test. If you wish to have an inspection of internal parts of the vehicle you should contact a different service provider who undertakes that type of inspection. mycar will not be responsible for any defects that are latent and which were not visually apparent during the inspection.

You acknowledge that while we use accepted methods for fault detection, these methods will not necessarily identify all faults with a vehicle. The Report will not cover intermittent problems not apparent at the time of the inspection.

The visual inspection will cover items in Annexure 2 and will not cover items set out in Annexure 1.

We may remove wheels, plastic covers and boxes, drive line caps and measurement instruments as part of the inspection in order to allow for visual checking of some items. We will not remove any other parts or components during the inspection process. We will not remove fixed items such as baby seats or coverings such as seat, steering wheel, or dash mat covers. We make an assessment on factors such as noise, operation, and performance on the road test. We will advise you if there are further limitations on our inspection, for example due to limited access or the requirement for specialised tools or equipment.

We will review service records when they are available, however, we will not assess the accuracy of records or the quality of the service. We do not review other vehicle documents including the owner’s manual or damage or repair reports or make any assessment as to the accuracy of such documents. We do not check for any manufacturer recall notices and you should check that the vehicle is not subject to a recall notice.

Vehicles are only road tested to the speed limit of local area. Some defects may only be apparent at higher speeds. Where a road test is included as part of any inspection, you must ensure that the vehicle has sufficient petrol to undertake the test.

We recommend that you carry out a Personal Property Security Register (PPSR) check if you are buying this vehicle through a private seller.



4. Repair Quotes

Any repairs quotes provided by mycar are an estimate only. As the inspection is visual only, some aspects of the repair may only be apparent after further diagnosis. We will provide a more accurate estimate before completing the work. Repair quote estimates are valid for 14 days only.



5. Limitations

The Report is our professional opinion on the overall condition of the vehicle, considering the age and condition of the vehicle at the time of inspection. This is subjective and based on the inspector’s knowledge and experience. The Report is designed to assist you to make informed decisions based on the condition of the vehicle only. mycar will not provide a recommendation to purchase or not purchase the vehicle, this is at the discretion of the customer only.

We can only advise on the condition of the vehicle at the time of the inspection and the Report is only current as at the time it is issued. If you are not the Customer, it is your responsibility to conduct a visual inspection of the vehicle at the point of sale.  

Subject to all applicable laws, we do not provide any warranty regarding the nature, reliability, accuracy or completeness of any information contained in the Report or the fitness of the information contained in the Report for any purpose intended. To the maximum permitted by law, we will not be liable to you or any third party for any claim (whether in contract or tort) for any loss, damage, injury or death to any person or property arising out of or relating to the Report. To the maximum extent permitted by law, our liability for breach of any implied warranty or condition which cannot be excluded is restricted to the resupply of services supplied or offered by us or, at our discretion, the payment of the cost of having those services re-supplied. You agree that our maximum liability to you is limited to the fees paid by you for the Services provided.

The report is not a roadworthy certificate and cannot be substituted for one. Notwithstanding the result of any inspection, we do not guarantee that the vehicle inspected would pass a road authority inspection.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.


6. Your risk

Some vehicles, particularly if they are older, may contain serious internal, structural, or mechanical defects or hidden corrosion. While we take every effort to identify potential problems, they may not be apparent on an external visual assessment.

  • Air conditioning efficiency
  • Performance or condition of any forced induction i.e. super charger/ turbo charger
  • Collision or accident checks
  • Paint thickness, limited to what is immediately visible such as chips and scratches and only if considered excessive by the inspector.
