Privacy Policy

1. Your Privacy is Important

1.1.
Tyre and Auto Pty Ltd trading as mycar Tyre & Auto (ABN 57 164 707 484) (we, us and/or our) is committed to protecting your personal information. This Privacy Policy explains how we collect, manage, disclose and use personal information, and why we use it. It explains how we comply with our obligations under the Australian Privacy Act 1988 (Cth) (Privacy Act), including the Australian Privacy Principles (APPs). It also sets out some of your rights in relation to personal information and how you can contact us if you have questions about our management of your personal information or if you want to access personal information we hold about you.

1.2.
When we amend this Privacy Policy, we will post the updated version on our website. All changes are effective from the date of posting the revised Privacy Policy. By continuing to use our websites after this Privacy Policy has been varied or by otherwise providing your information to us, you agree to be bound by the variation.

2. What is Personal Information?

2.1.
Personal information is any information or opinion that can identify or reasonably identify an individual, whether true or not and whether recorded in a material form or not.

3. What Personal Information Do We Collect?

3.1.
The personal information we collect includes:
• Contact and billing information: Your name, home or work address, delivery address, phone number, payment, credit card and billing information, and email addresses;
• Demographic information: Which is not unique to you, such as your postcode, age, gender and shopping preferences, interests, and favourites. We may also collect specific information about your vehicle (including VIN (engine) number and registration number); and
• Analytics and marketing technology: When you visit our websites, we may use cookies, pixels, tags, and similar technologies to collect information about your device, IP address, browser, and use of our website. These technologies may be operated by third-party providers who may combine this information with information from other sources.

3.2.
We may collect additional information that you provide us including:
• Purchase history, location, and preferences, either directly or through our business partners (including Flybuys, fleet customer accounts, and electric vehicle partnerships), our related bodies corporate, associated social and other media platforms and accounts from which you permit us to collect information;
• Personal information that you provide to us, directly or indirectly, through your use of our site, associated applications, associated social media platforms and accounts from which you permit us to collect information;
• Your browser session and geo-location data, device and network information, statistics on page views and sessions, acquisition sources, search queries and browsing behaviour;
• Vehicle information, including for electric vehicles, including data that may be automatically transmitted from your vehicle to the vehicle manufacturer or a related entity. This includes telematics log data including but not limited to:
   o Vehicle status information including speed, battery and charging, odometer readings, vehicle mechanisms, and electronic control unit information;
   o Cellular data usage;
   o Other data to assist in identifying issues and analysing the performance of the vehicle;
   o Map navigation systems; and
   o Information relating to the vehicle identification number (VIN), real-time locations and address details.

3.3.
We also collect information about:
• Contractors, service providers, suppliers, and their employees, including business name and address, contact details, bank account details, and employee names, birthdates, addresses and working conditions (when provided by the supplier); and
• Potential employees (including names, addresses, contact details, employment and academic histories and the names of their referees).

3.4.
If you telephone our stores or general enquiries line, we may record the call.

3.5.
We understand that anonymity is an important element of privacy. In some situations, you may choose not to identify yourself or identify yourself using a pseudonym. However, if you do not provide accurate personal information to us, we may be unable to provide you with products, payments or services that depend on the provision of that information.

3.6.
We do not collect, use or disclose sensitive personal information other than payment, credit card and billing information. We collect payment, credit card and billing information in order to procure payment for products or services you request, however such financial information will be treated in a different manner to the rest of your personal information, as detailed below.

4. How We Collect Personal Information

4.1.
We collect personal information from you in a variety of ways, being when you knowingly provide it directly to us, such as:
• When you make a booking with us through our website, over the phone or in store;
• When you request a quote from us;
• Engage in correspondence with us;
• Enter into arrangements with us; or
• Provide feedback/complaints to us or register your details with us.

4.2.
We aim only to collect personal information that is necessary to carry on our business and to supply you with the goods and/or services that you have contracted or requested us to provide. However, we may also collect information about you to do internal research and to conduct market research for our own purposes.

4.3.
While we endeavour to only collect personal information from you directly, we may also collect information from the following sources that you may be unaware of including:
• Third parties (such as our suppliers, agencies on our behalf or our commercial partners such as Flybuys);
• Personal interactions with Tyre and Auto Pty Ltd employees; and
• Recruitment agencies.

5. How We Use Information

5.1.
When we collect personal information from you, we will use it for the reasons we collected it and for other reasonable business purposes, which may include:
• To communicate with you throughout the booking, drop-off, service, collection, and billing process;
• To deliver, improve, and personalise our products and services;
• To respond to feedback or complaints and provide refunds and discounts;
• To better understand our customers’ requirements and preferences, conduct product and market research, personalise, and improve our service and to provide offers that are of greater interest or benefit to you;
• To deliver and measure advertising, marketing analytics, and website improvements, including through the use of third-party advertising and analytics technologies;
• To communicate with you including to operate the customer care centre;
• To analyse trends and demographics;
• To manage our stores, supply arrangements and inventory and administer our websites;
• To protect you against fraud and theft and conduct investigations;
• To complete other transactions with you or on your behalf with your consent;
• To recruit and assess future team members; and
• To maintain and update our records.

5.2.
From time to time, if you have agreed to receive marketing communications from us, we may use your personal information to send you targeted news, offers and promotions about our products and services. We may contact you by various means, including by mail, telephone, email, SMS, or other electronic means including targeted advertising. If you do not wish to receive these communications, you can opt-out by using the opt-out facility and following the instructions provided in the communications, or by contacting us at the address or phone number listed below.

5.3.
We may also provide you with the opportunity to opt out of service-related communications by email/SMS. However, mycar will still confirm your booking and provide service-related communications, including service updates and post-service observations, by phone, SMS or email (where required).

5.4.
We will only use sensitive information (payment, credit card and billing information) we hold about you for the primary purpose for which it was collected or for a purpose directly related to the primary purpose, and where you would reasonably expect us to use or disclose it for that purpose.

5.5.
We do not use or disclose personal information on public Artificial Intelligence (AI) platforms. We do not permit personal information to be used or disclosed on public Generative AI platforms. We also do not use or disclose personal information for automated decision-making purposes.

6. How We Disclose Your Information

6.1.
We will generally only disclose your personal information to third parties if the disclosure is necessary to answer your enquiry or request, to supply you with products and/or services requested, or to complete the services we provide.

6.2.
We may disclose information about you to third parties:
• Where we have sought your consent or as is otherwise allowed or required by law;
• To our advisers and companies who are responsible for parts of our service delivery, including, but not limited to, IT service providers, external call centres, professional advisors, payment systems operators, Flybuys (Loyalty Pacific Pty Ltd), delivery companies, suppliers and manufacturers, mail houses, marketing or advertising providers, and recruitment firms;
• To third-party technology providers who assist us in providing marketing analytics, website services and advertising, and who may share information with their own partners and sub-processors to deliver these services;
• To any entity to which we propose to assign any part of our business;
• Including other organisations with whom we have contractual agreements; or
• Where we communicate information about your vehicle back to the manufacturer or other service providers as part of automotive servicing, repairs, and warranty services.

6.3.
In special circumstances (for example, if we were to sell our business or part of our business) your information may be transferred to potential purchasers and their advisers as part of that sale. From time to time, we may provide aggregated and de-identified information to other business partners for various purposes.

7. Transfer of Personal Information Outside of Australia

7.1.
We may occasionally transfer your personal information, including sensitive personal information (payment, credit card and billing information), to organisations located overseas, in the following circumstances:
• When we use service providers based overseas;
• When we need to comply with foreign legal or regulatory requirements;
• Where an international payment has been made; or
• Where information is stored on computer servers located outside of Australia.

7.2.
Any offshore disclosures will be to entities located in United States of America, Canada, Europe (including the United Kingdom and Ireland), and the Asia Pacific region.We require our direct service providers to use personal information only for the purpose provided and to implement strict confidentiality and data protection arrangements. In all instances of overseas disclosure, we shall ensure that the transfer of your personal information is carried out in accordance with Australian privacy and data protection laws.

7.3.
We will not send your personal information outside of Australia unless:
• It is necessary (including to provide the personal information to a third party) to provide our goods and/or services to you;
• You have provided your consent;
• We believed on reasonable grounds that the organisation involved would only deal with your personal information in a similar manner to the requirements under the APPs; or
• Where otherwise allowed by the Privacy Act.

8. Accessing and Correcting Your Information and Questions

8.1.
Please contact us at the address below if:
• You wish to request access to or correction of your information; or
• You have a question about this Privacy Policy or wish to make a complaint about the way we have collected, used, held, or disclosed your personal information. We may need to contact you for further details in such cases.

8.2.
If you believe that any information we hold about you is incorrect or incomplete, please contact us as soon as possible. If you have requested that we amend or correct your personal information, we will take prompt action to do so and ensure it is accurate and up to date.

8.3.
We take your privacy seriously and will respond promptly to concerns and enquiries within 30 days. If we have not responded to you by this time or if we are unable to satisfactorily resolve your concerns or complaint, you are entitled under the Privacy Act to make a complaint to the Office of the Australian Information Commissioner (see their details below).

8.4.
We may not comply with your request if, in our reasonable opinion, there is a proper and lawful basis for not doing so. In this case, we may deny access in part or in full to the extent it would not be permitted under the Act and we will advise you of our decision in relation to your request for access.

9. Storage and Security

9.1.
Any information that we no longer use for the purposes contained within this Privacy Policy is destroyed. The exception to this may be information required for possible data analysis at a future date, or information we are legally required or advised to hold for specific time periods. Wherever practicable subject to the above, the information will be retained in a form that does not allow you to be identified.

9.2.
The security of your information is important to us. When we have collected information about you it cannot be seen or modified by anyone other than those authorised to access the information for the purposes stated above. We will endeavour to make reasonable efforts to ensure information is stored securely both in electronic and physical forms and to keep this information accurate, up to date, complete and relevant. Your personal information is stored on password protected servers located in access controlled secure locations. We ensure only those necessary have access to your personal information. Physical, electronic and managerial procedures have been put in place to reasonably secure any information collected from misuse, interference or loss, and in order to prevent unauthorised access, modification to or disclosure of that information.

9.3.
We utilise systems, services and third party platforms to manage and store your personal information that are located outside of Australia. However, we will never lose effective control of your personal information other than as detailed in this Privacy Policy.

10. Links to Other Websites

10.1.
Our websites may contain links to other websites of interest. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Remember, this Privacy Policy is strictly limited to our collection, storage and use of personally identifiable information collected via our websites or otherwise in the course of our business, and does not apply to any third parties. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such websites and such websites are not governed by this Privacy Policy. You should exercise caution and look at the privacy statement policy applicable to the website in question.
